Policies, Terms and Fees

Terms & Conditions

Merchandise is priced and sold based on customer pickup from our warehouse in Harrisonburg, Virginia, or scheduled delivery route. Goods become the buyer’s property when signed for by the buyer’s representative.

Please inspect all merchandise upon receipt. Any shortages or other apparent errors should be noted on the delivery ticket. The buyer should call TopSource immediately with any issues noted. If the merchandise you receive is damaged you should refuse delivery.

Regular Terms

Deposits required and balance due on delivery for accounts without approved credit.

For accounts with approved credit, terms are 1% 10 days, or net 30 days from date of invoice, quartz jobs excepted.

For natural quartz tops (Silestone, Avanza), terms are net due at delivery with finance charges beginning after 10 days (approved credit customers only). Discounts do not apply to quartz orders.

A 2% per month finance charge will be added to all past-due invoices.

No deliveries will be made to any past due account without special prior arrangement from TopSource management.

Customers issuing returned checks will be billed a $50 Net service charge plus any additional costs.

NOTE: All accounts over 60 days will be turned over for collections unless special arrangements with TopSource have been made. Any and all legal costs associated with collections will be the responsibility of the customer (see Guaranty Agreement in the Appendices)

Additional Terms & Conditions

This contract, including customer account information sheet, contains the entire agreement between the parties. Any statement, promise or inducement made by TopSource Corporation or approved agent of TopSource not contained in this document is not valid or binding unless in writing.

Pricing

All prices are subject to change without notice. TopSource Corporation reserves the right to ship and invoice all items at prices in effect at the time of receipt of the order. Orders requiring a template will be upcharged if final measurements are greater than those provided by customer with the original sales order or quote.

Product Orders

All orders must be faxed to TopSource at (540) 437-1911 using TopSource order forms.

All custom top orders must be faxed with an accompanying drawing to exact size specifications. Any change in orders or delivery instructions must be faxed.

Orders received at TopSource will be acknowledged via faxed Sales Order Confirmation within 24 hours of receipt. If you have not received a Sales Order Confirmation within 24 hours, contact TopSource immediately.

Customers must review faxed Sales Order Confirmations within 24 hours of receipt. Customer should carefully check items such as product specifications, delivery dates, etc. Customer will be responsible for paying for items as noted on Sales Order Confirmations regardless of errors, miscommunication, etc. if not reviewed and corrected within the 24 hour review period.

Credit Policy

An approved TopSource Credit Application (see form in the Appendix) must be approved and issued before credit orders will be accepted. To process a new order, the sum of order’s value and the value of any prior outstanding orders and invoices must not exceed the customer’s approved credit limit. Customer’s credit line must be in good standing for orders to be processed or delivered. Clients with overdue invoices are subject to immediate suspension of all pending orders until account is made current. All credit approvals must be in writing.

All orders for customers with pending credit applications will be processed with C.O.D. terms so long as customer is otherwise in good standing.

Return Policy

Merchandise may not be returned for credit without prior inspection and written authorization from an approved representative of TopSource. The following conditions apply:

All replacement tops will be billed when shipped

Credit will be issued when the defective top is returned

All returns must have copy of the dealer invoice attached

No returns accepted 30 days after date of receiving product

No returns will be accepted without prior written approval. Any return must be made within thirty (30) days of delivery date. Customer’s account will be charged a 30% handling and re-stocking charge. No damaged or previously installed merchandise will be accepted for return unless the product is covered under warranty. Special order and custom-made products are not returnable except in cases of material defects.

Canceled Orders

If an order is canceled before being processed by our supplier and before any fabrication, no charges will be assessed. The buyer may be responsible for the full sales price if materials are on order and/or fabrication has begun at time of cancellation.

Customer is responsible for template charges if order is cancelled after template is complete.

Customer is responsible for marble setup fees for any order cancelled after mold has been prepared for a custom top.

Product Quotes

All requests for quotes should be faxed to (540) 437-1911.

Quote requests should include a drawing with exact size specifications.

Residential quotes will be issued no later than the end of the second business day after receipt. Larger commercial quotes may require longer periods to complete.

Quotes are valid for 30 days.

Verbal quotes will be provided on request, but are discouraged and are not binding.

Warranties

Each TopSource Corporation product is warranted free of defects in workmanship and materials. Should any product fail to conform to warranty, TopSource Corporation will repair or replace the defective merchandise at our discretion. All claims for defective goods must be made to TopSource Corporation within five (5) days of receipt of the merchandise. Labor allowance or installation costs for products not installed by TopSource are not covered under this warranty. TopSource will not be responsible for labor charges incidental to installation such as electrical or plumbing. No expressed warranties other than those specifically set forth herein are made.

Specific warranty details for each product line are included in the applicable section of this manual.

Design Notes

On custom tops that have custom shapes with complex angles, or curvature, an on site template of the exact size is required. Please be aware that installers normally must “scribe” tops to walls by making slight indentions to the wall surface to provide a proper fit.

Literature and Product Samples

A limited number of Literature and Product Samples will be provided to each new customer. Additional literature and product samples will be distributed based on request, availability, and sales volume.

Jobsite Delivery

Appointments must be pre-arranged for jobsite deliveries.

Customers will be billed $100.00/hour Net for each hour driver has to wait for the truck to be unloaded after 15 minutes.

Directions to jobsite must be included with order.

Customer is responsible for unloading product.

Cultured Marble

TopSource is proud to offer the finest cultured marble product line available anywhere. Manufactured in our modern facility in Harrisonburg, Virginia, each top is finished to the highest standards of clarity and fit.

We offer all standard size vanity tops. We can also manufacture a very wide variety custom size and shape tops.

The “Recessed oval” is our standard bowl. We also offer eight other custom bowl styles (see illustrations later in this section).

Our Select series includes our four most popular and economical marble colors.

The Onyx series features the beautiful veined translucent onyx style of marble. It is offered in six colors.

Our Granatex series is an upscale line made to resemble the look of granite. This series is offered in eight colors.

In addition, we can match custom colors requested not currently in our catalog. Call for details.

Both gloss and matte finishes are offered for all tops, though the matte finish is not recommended on dark colors.

Cultured Marble Warranty

Limited 10 year Warranty

If the product is found to have a defect within the terms of this warranty, TopSource will repair or replace the product at its discretion. TopSource will not be responsible for any labor or other charges such as electrical, plumbing, and/or installation which may be incidental to removing or replacing a defective product.

This warranty does not cover issues such as improper installation, improper care and maintenance, accidents or misuse.

Cultured marble tops are artisan crafted and made from natural materials. As a result, each top has a unique look and character. Each top is subject to slight warpage, small air bubbles, and small particles of foreign matter. Each top is subject to variation in color and veining from samples and between production runs. These issues are not considered defects and are not covered by this warranty.

No fabricator, installer, dealer, or employee of TopSource has the authority to modify the terms of this warranty.

The purchaser (dealer/customer) is responsible for thoroughly inspecting each top for damage and defects at time of delivery. A signed delivery ticket indicates that the product was delivered in satisfactory condition. No claims for damages will be accepted after the dealer/customer signs the delivery ticket.

Customers should contact their dealer for warranty service. Original proof of purchase must be presented when requesting warranty service.

Care and Maintenance

Cultured marble is a beautiful product that with proper care and maintenance will look beautiful for years. To help keep your new fixture looking its best we’ve listed a few tips.

Keep your water temperature below 135°F. This temperature would be unusually hot for most baths and showers. Hot water at or above this temperature could cause thermal cracking.

Cultured Marble is not recommended for homes equipped with a summer/ winter hook-up hot water system.

DO NOT over tighten drain assembly or fixtures as this may crack cultured marble products

Water should hit the open drain when in use. A dripping faucet will damage cultured marble.

DO NOT place hot objects such as ashtrays or curling irons on cultured marble surfaces.

DO NOT leave objects (such as tissue boxes) in the same location for a prolonged period of time. Prolonged shading of top areas may cause discoloration under the object. If this occurs, remove the object to allow sunlight to reach the affected area. With sunlight and time the color should return to normal.

Using an automotive paste wax monthly will restore luster and help protect the polyester finish.

Stains that are not easily removed with the cleaners listed above may be lightened considerably by an application of chlorine bleach.

Laminate surfaces are subject to minor surface imperfections and color variations. Any such imperfections falling within standard manufacturing tolerance are not considered defects.

Care and Maintenance

Laminate surfaces may stain. Exercise caution when exposing the surface to any material that might discolor the top.

Use hot pads and trivets to prevent exposure of the surface to temperatures above 150°F.

Do not use abrasives such as Comet, or scouring pads, or steel wool to clean the surface.

Be especially aware of sustained water damage to the top from dishwasher leakage, or standing water locations on the top. The tops will warp if not kept routinely dry.

Corian, the original acrylic surface from DuPont, is still the most recognized solid surface product available. Corian is more competitively priced than ever before.

Hi-Macs is an outstanding product line that rapidly became the second largest volume solid surface line in the U.S. An excellent economical alternative to Corian, the product features a large array of colors and sinks along with a 15 year limited warranty.

Staron, recently featured on ABC’s Extreme Makeover – Home Edition, is a high quality alternative offered with more than 50 colors, and an impressive group of high quality sinks.
